TOWN OF BROOKLYN Regular Monthly Town Board Meeting April 12, 2005 - 7:00 P.M. W1208 State Road 23-49 ---- Green Lake, WI Web: www.tn.brooklyn.wi.gov Minutes Install elected officials - if not done -Clerk indicated that all had signed oaths Call Meeting to order.- by Chairman Mike Wuest at 7:00 pm. Present: Chairman: Mike Wuest; Supervisors: Ron Benson and Susan McConnell; Clerk: Marian Mildebrandt; Treasurer: Kathleen Morris; Assessor: Elizabeth Rowley; Attorney: Robert Wertsch. Pledge of Allegiance said by all in attendance Informal public comment time - Duane Halversen - new alderman for the City of Green Lake introduced himself to the Town Board. David Ryan was interested in why the election signs were taken down, and then Mr. McMonigal's went back up. Clerk indicated that it was legal to have the signs where they were placed. They were taken down by mistake. Eugene Janes - wanted to know if the Town Board wanted to do something about the stray cats. Mike Wuest indicated the Board would look into it. Are we in compliance with open meeting law? Clerk - yes we are, the agenda was posted at Town Office; Recycling/Sanitation Center; Classic Auto Service, and published in Green Lake Reporter. Rules of meeting - Mr. Wuest indicated that he would allow talking for about 1 minute for comments on items so we can keep the meeting moving along. Approve Minutes of March 8, 2005 meeting M/S to approve by Ron Benson/Susan McConnell. o Motion carried 3 - 0 Reports o Building Inspector - was not present - arrived after meeting was done. o Roadmen - Report on work being done. - Mike Wuest - will report tonight. Norbert Jahnke is patching roads and doing trash pick up. In the position of being roadman - he (Mike Wuest) has to back off. He is asking to put the ad in the paper looking for part-time help. Board approved running the ad for 2 weeks. o Library - Report on library activities - David Ryan - this is National Library week. Friends of library will have a book sale the same day as the citywide garage sale. Long range planning - try to utilize space in the lower level for the next 5 years, with a separate entrance. The building is 11 years old. Usage is up. The City is responsible for the maintenance of the building and the rest of the budget is 50/50 with the Town Motion by Chairman Wuest to re-appoint David Ryan to a full 3-year term on Library Board - He indicated he enjoys it. M/S Ron Benson/Susan McConnell for a full 3-year time - Motion carried 3-0. o Recycling/Sanitation Center - Ron Benson. He has had several contacts with Onyx regarding the dumpsters not being dumped in a timely manner.- one truck comes Horicon and the other truck comes from Omro. 1. Set dates for W/M big dumpster - May 9 - May 14 May 16 May 21. Pat Dusterhoft will call WM for arrangements. 2. Summer hour schedule Starting May 2, 2005 the Recycling/Sanitation Center will be open on Saturday and Monday mornings from 7:30 to 11:30 a.m. and continuing through the last Monday in September . 3. Mike Wuest reported- Eugene Janes caught someone throwing a bed over the fence. He wanted to acknowledge that Eugene Janes took the time to stop and talk to him and handle the situation. o Fire Commission 1. Update on Town of Green Lake Fire Protection Agreement - - Attorney Wertsch. - Attorney Sondalle is working on the written agreement. At the present time it is a verbal agreement. 2. Update on suggestions of Ordinances the city would like to implement- no one present. o Plan Commission - Ron Benson Discuss Subdivision/Land Use Ordinance - The Plan Commission has to decide if the County Land Use Ordinance is enough. We started on a Land Use/Subdivision Ordinance when Susan Ballbach was our planner. When she left it stopped. We've had two meetings with Amy Emery from Omnni. We will have one more meeting and then should be able to present to the Town Board. Attorney Wertsch indicated he has several pages of questions. He will sent to Amy Emery if ok by the board. Board agreed he should send them to Amy Emery. 2. Next Plan Commission meeting April 27, 2005 7:00 p.m. o Financial - Treasurer Kathleen Morris 1. Monthly report. - Lottery credit is dispersed to the county, schools by the 15th of April . M/S by Mike Wuest/Ron Benson to approve the financial report. Motion carried 3-0 2. Approval of checks issued from March 9, 2005 - April 12, 2005 Check 7817 - 7874 $34,720.23. M/S to approve checks by Ron Benson/Susan McConnell Motion carried 3-0 o Chairman Mike Wuest 1. Update on Complaints on W831 North Court junky yard- Mike Wuest talked to the Green Lake County Zoning Office. They have issued a violation notice. It was for the lumber, pallets, and unregistered car which have been removed They also cleaned up some of the trash. There are 3 vehicles all licenses, one boat and one trailer, and small utility trailer. Scott Rogalsky from Zoning said he will be going out between now and the end of the month to assess the situation. If all is well, the County will drop the violation. County Zoning will let Mike Wuest know the results. 2. Designate Supervisors to Recycling/Sanitation Center and Plan Commission. Chairman Wuest opened up the discussion to the supervisors for their opinions on who should be responsible for these two items. Supervisor Susan McConnell feels that she should not be chairperson of the Plan Commission, as she is on the Green Lake County Zoning Committee, and feels that Ron has a good handle on the Recycling/Sanitation Center. Ron Benson - will do both Recycling/Sanitation Center Supervisor and Plan Commission Chairman. Chairman Wuest accepted Ron Benson's offer. 3. Discussion on Beyer's Cove No Wake Zone Ordinance - Mike Wuest indicate he had a question on Item 6. He talked with Allen Weckwerth from Town of Princeton. It is Mr. Weckwerth's understanding that it is a boundary issue, and the Town of Brooklyn would have no control on it. Town of Princeton has to post only 2 no wake zones. The County Law Enforcement Officials would enforce it. Mike Wuest will tell Mr. Weckwerth that we will agree to the ordinance it if he gets the ordinance in order for our signatures. 3. Set date to inspect roads - The Town Board will meet on Friday the 15th to inspect the town roads. Will leave officially from here at the town hall. The Board will meet at 12:30 p.m. 4. Brooklyn G repairs - Between Prairie and Skunk Hollow. The road is breaking up. Mike Wuest went out and cleaned out the broken area. We are down to the base above the culvert. During the past 3 years we have been patching it. Tomorrow morning Mike Wuest has an appointment with the county highway department to go out and assess the damage. We are considering on removing a square area and refilling with gravel, then leave sit for a few days. Then put a patch of blacktop on. Since it is being done with the county, it is an intergovernmental agreement; there is no need for bids. M/S that we fix Brooklyn G but go no higher than $10,000. by Ron Benson./Susan McConnell. Sweep sand and gravel off streets - The Town Board feels too much sand and gravel are being used on town roads. Mike Wuest feels that we should be using salt only. He offered to look into the use of salt/sand mixtures. Several areas are very heavy with sand/gravel again this year and need to be sweeped. Lac Verde Circle, Sugarloaf are a few of them. The Town Board will look over the roads during the inspection and decide which roads need to be swept. 6. Set date to review employee handbook- Mike Wuest feels that it should be closed session, as employee names may be used. Attorney Wertsch agreed. o Supervisors 1. Ron Benson - During the Plan Commission, Susan McConnell brought up concerns that people don't know how to get listed on the agenda for the Plan Commission. Susan McConnell: She feels that people don't want to go Green Lake County Zoning, as to appear before them costs money in permits. She feels that we developed the Comprehensive Plan, therefore we should be a sounding board for people. Ron Benson: It is his opinion that if someone comes to us with a question without a request from County Zoning, we cannot give them a firm answer, as if they do go to County Zoning, we may hear later something that was said at the first appearance at the Plan Commission meeting. For example Ron Benson used the Lake Steel Street encounter we had recently, where we talked for an hour and nothing came of it, as it had not come from County Zoning. Ron Benson would like to see a page on the website on what the Plan Commission does and a form to complete. Susan McConnell feels that since we lost our planner there is no one at the town level to contact to run ideas through. Ron Benson feels that if people contact him, he would get answers for them. As Chairperson of the Plan Commission, we will not response to the vague requests. If they have a firm question, he will answer. Mike Wuest, if they don't come with a formal request, we won't honor them. Also we changed the answering machine and either the Chairman or the Clerk will check the answering machine twice a day and we will response to calls in a timely manner.. 2. Susan McConnell - no report o Clerk 1. Request approval to attend Municipal Clerks & Treasurers Institute in Green Bay From July 10 - 15, 2005. This is the third year of the program. Cost will be $634 plus mileage. M/S by Ron Benson/Susan McConnell to approve Clerk to attend. Motion carried 3-0 o Assessor - Elizabeth Rowley 1. Set date to convene Board of Review (during 30 day period starting the 2nd Monday in May) (which is May 9th). Elizabeth Rowley suggests that we convene the Board of Review at 6:55 p.m. on May 10th prior to the Town Board meeting and adjourn to the July 12th, again before the Town Board meeting. Attorney 1. Update on Fire Dept/First Responder Agreement with City of Green Lake - Ron Benson will be town representative and they will meet April 18 with the City and Attorney Wertsch. 2. Update on Lillian Street home. Green Lake County is still getting responses from the owners - The County is still not asking us to get involved at this point in time. The County will keep us informed to the status of the clean up. 3. Update Hillside/North Court illegal driveway - Attorney Wertsch thought this was taken care of. The house has been taken off the market. The owner may move back in. - Town Board will look at the situation when they inspect roads. 4. Irving Park Road Damage (update) - Attorney Wertsch has things ready to go. He wanted to talk to the new board before proceeding. The owner did not contact the Town Board when the roads were posted, The owner just told the truck driver to drive on the road, even though they both knew the truck and load were over posted weight limit. The truck driver apparently did not want to travel on posted roads but followed the owner's request. Next step would be a summons - Chairman Wuest is in favor of pursuing, 5. Update road damage - Forest, Camelot Trace and Belle Mapps Roads - Chairman Wuest has talked with 2 other town chairman who have experimented with the cold mix. We should go in, in the summer time when hot, blow out cracks, go and roll down with a heavy roller to blend back together. Mike Wuest feels we should try to roll it this summer and see how the road responds. Ron Benson feels that we should get whatever we can from Scott Construction in a check not credit - Attorney Wertsch & Chairman Wuest will work on it. New Business 1.Cell phone - Instead of getting cell phones for the Chairman and Clerk, they are requesting the town pay 1/2 of their current cell phone bills.- Mike Wuest indicated is willing to use his personal cell phone and the clerk also indicated she would appreciate the town paying half of her monthly bill. It is a set rate and doesn't show how much time is used on individual call. The Town Board wants to think about it. 2.Purchase laptop computer - Mike Wuest indicated the town has had computer problems - We can get a re-conditioned laptop for $695.00 vs. $1400 for new laptop. Ron Benson will have someone look into it for us. Request will be tabled to next month's meeting Public Comment - Orlo Bierman: Re: How to get items on Plan Commission Agenda if not started at the County Level: the Town doesn't' have a zoning ordinance. Requests should at this time start at the County Zoning Office and they should be firm in their ideas and be willing to pay the permit fees.. There should be a resolution commending Roger Ladwig for his years of service. Should be on the agenda for next month. Attorney will handle.
