Kallas Tax Parcel #s and Legal Descriptions: 0040853-0000 - NE 1/4 of the NE 1/4 Section 24 T16N R12E (+ or - 38.746 acres), Town of Brooklyn. Location of Premises Affected: W2551 Princeton Road (Intersection of St.Marie & Princeton Road). Explanation: Rezone request from A-1 Exclusive Agriculture District to A-3 Light Agriculture District. Amy Emery Staff Report: Basic rezoning case with a piece of property just over 38 acres. If you rezone the entire property you could have 3 houses on the property. She explained the differences in the zoning descriptions. In general comprehensive plan, this is not planned for residential lots. Recommends denial -not in agreement with the Town plan. Mary Kallas: She has no plans of having more than one lot sold off, but she understands that the zoning goes with the land. She agrees with idea of rezoning only one lot as R-1 and leaving the rest of the land as A-1. She indicated that she could sell her house with 1.+ acres and then she could build a new home. Sharon Gebhardt: You can bring it back another request with re-zone on 3.746 acres. Public Comment: Roger Ladwig Ð owns property near there, it's against land use plan, it should be all A-1 - and it should stay there. He would rather not see any more homes in the area. Commission: Total rezoning is out. There is quite a distance between the houses out there and her property. Discussion between members. Ron Benson - What would your tolerate. Phyllis Peterson, What if someone else comes and wants the same thing? It's not a hardship. Ron Benson the request is for a straight re-zoning. Orlo Bierman - wrote a letter. If you (the rest of the commissioners) cannot make a meeting, I would be willing to read a letter to the rest of the committee. M/S Phyllis Peterson/Sharon Gebhardt to turn down the request from A-1 to A-3. Roll Call: Phyllis Peterson, yes; Mary Jane Bumby, Yes; Carolyn King Yes. Sharon Gebhardt, Yes; Tom Esslinger, Yes; Ron Benson, Yes. Motion to defeat the rezoning request passed 6-0. Question Mary Kallas, should I go to the March meeting of the County. Ron Benson, we give them our vote, they could over turn us, but normally do not. Mary Kallas, doesn't want to keep applying for different options and always being turned down. Tom Esslinger - the only choice you would have would be to come back with the 35 and 3+ acres, and then it could still be defeated. Phyllis Peterson - she is not in favor of any rezoning with the land as it's against the Comprehensive Plan. Discussion continued. Adjourn. M/S Tom Esslinger/Sharon Gebhardt to adjourn. 8:00 p.m. Requests from persons with disabilities that need assistance to participate in this meeting or hearing should be made to the Town Office at 294-6600 with as much advance notice as possible. Marian Mildebrandt, Recording Secretary
