TOWN OF BROOKLYN NOTICE OF PLAN COMMISSION MEETING July 3, 2008 6:00 PM Town Office — N5988 County Road A ---- Green Lake, WI E-mail: townofbrooklyn@centurytel.net Web: www.townofbrooklyn.com NOTICE: Members of the Town of Brooklyn Board may attend the Town of Brooklyn Plan Commission meeting at the above-specified time and place. Members would attend for the purpose of gathering information regarding the following Agenda. The Town Board members at this meeting will take no votes or other action. Minutes 1. Call meeting to order by Mike Wuest at 6:00 p.m. Present: Mike Wuest, Chair; Harley Reabe; Orlo Bierman; Mary Jane Bumby; Ron Triemstra; Roger Priebe, & Marian Mildebrandt, Clerk. Absent: Sharon Esslinger. 2. Pledge of Allegiance - Said by all in attendance 3. Approve minutes of the last Plan Commission from June 5, 2008. M/S Reabe/Bierman to approve minutes as presented. Motion carried 5-0 4. Public Comments: (15 minutes) 5. Public Hearing (15 minutes) – Variance forms & fees for the Town have not been filed or paid, therefore M/S Wuest/Reabe to table to next month’s meeting if forms are presented. Roll call: Bierman, Yes; Bumby, Yes; Triemstra, Yes; Priebe, Yes; Reabe, Yes. Motion carried 5 – 0. 6. Consideration and action: - a. Item I: Owner: Daniel N & Joan M Ambrosino Applicant: Don Lenz, Green Lake Surveying Co. Address: W2081 Irving Park Road, Parcels #004-00990-0000 & #004-00991-0000 – Irving Park Plat Lots 1 & 2 Certified Survey Map 2860 V14 (A Resurvey of Lot 1 CSM 2722, Section 29, T16N, R13E, Town of Brooklyn (+ 2,761 Acres) Explanation: The applicant is requesting a variance to Section 315-34.B. of the County Land Division Ordinance and Section 338-13.B. of the County Shoreland Protection Ordinance to allow the modification of a lot line creating 2 new land areas, but not providing the minimum average lot width of 100 feet for one of the new land areas. 7. Consideration and action: Discussion with Al Shute from County Zoning and Planning on County and Town Land ordinances. Discussion on the 10 items presented to Al Shute. 1. What is the County's in-house procedure for processing a subdivision? 2. Who does the technical and engineering review of a plat? 3. How does the County handle "concept plans", if that is part of their procedure? 4. What weight does the County put on a Town's comments, or recommendations, when a Town does not have a platting ordinance? 5. Does the County respond to a Town's registering complaints about a developer not completing a plan/plat according to the "developer's agreement" with the County? 6. Who or how well does the County monitor a developer's progress and compliance with the County's Subdivision Ordinance? 7. Does the County have a Conservation Subdivision Ordinance (category)? 8. If yes, can the County directly invoke it? 9. Is the County going to invoke it? 10. And if not, can a Conservation Ordinance3 be invoked by citizen petition? Discussion was held on the above 10 items. Mr. Shute indicated that the town ordinance is stricter that the County’s. Fees are $200 per plat plus $15.00 per lot for primary and also for final plat. We do check items to make sure done. Wuest: The town does more engineering work and that is why our fees are more expensive. Reabe: Does Land Conservation have fees also, Shute doesn’t know what they are, but they are significant. Triemstra: we are unique that we have an ordinance standing. What weight does your staff put on the work that the town has required to be done on plats? On plats, if sanitary lines are going across private property, it should be shown on plat. The two ordinances have differences on how a road should be built. The Town should have an ordinance that handles road development, and let the county handle the basic subdivision parts. The Town would like to be informed when a change is made in the subdivision ordinance, so that we can review our ordinance. The Town doesn’t want to make it so difficult that developers don’t want to develop in the Town. Shute: A possibility would be to trim your ordinance down, and still have the control, maybe make it a Land Development Ordinance for example. Subdivisions – that are built in the county and are not under county zoning -- do they have to abide by county zoning? - Shute: yes. County has an ordinance. An Ordinance controlling: Building, Numbering and Maintenance. This was developed through judicial law and developed due to the fact that someone on a private road named a road similar to the existing town road. Lots of problems developed with the naming of the private road. At the county level, after a plat is recorded, other groups supervise the development of the plat. Discussion of Plan Commission: Bierman – thinks we should do think about all the information we received tonight, and discuss it next month. 8. Suggested agenda items for next meeting - Subdivision plan, and variance if plan is presented to the town. Also the ETJ Committee? 9. Set next meeting date & time- August 7, 2008 6:00 p.m. 10.
