TOWN OF BROOKLYN Regular Monthly Town Board Meeting March 8, 2005 - 7:00 P.M. W1208 State Road 23-49 ---- Green Lake, WI Minutes - Call meeting to order by Roger Ladwig at 7:10 p.m., present: Roger Ladwig, Ron Benson, Marian Mildebrandt, Robert Wertsch - Pledge of Allegiance - said by all in attendance - RL read rules of conduct for the meeting. He will have another informal comment time at the end. - Informal public comment time - - Sydney Rouse - wanted to know how long the town is going to waste our money on frivolous lawsuits against the city. - Orlo Bierman - on same idea - the city does not go after the land, the landowners want to join the city. Is anything to gain by doing this? He asked the attorney what odds are on us winning. Attorney Wertsch - most of the times the cities winÉ but that's not all the time. Sydney's concern is holding up on the medical clinic at the taxpayer's expense. - Are we in compliance with open meeting law, and rules of meeting .Yes, published in Green Lake Reporter, posted at Town Office, Classic Auto Service and Recycling/Sanitation Center. - Approve Minutes of February 8, 2005 meeting. M/S to approve by Ron Benson, seconded by Roger Ladwig to approve - Motion carried 2-0. - Reports - Building Inspector. Report on any building permits issued. - Issued 1 permit for footing and foundation - this will be the last one without issuing a fine. It has been over a year. o Review UDC Ordinance - Attorney - prepared a revised ordinance - adding in section 1.3 it shall also include remodeling on homes prior to 1980 only on areas to be remodeled. - Ron still is concerned about who would need to a building permit. There is a limit of anything under $1000.00 does not need a repair. Ron - Betty can tell us when the homes are built. Roger recommend to table until next month. Ron asked Jerry to bring examples of plumbing, electrical - for a kitchenÉ of repairs over $1,000. What would be required? If you have 60 amp, or not, if walls are opened up or not. - What concerns you have as an inspector to have a safer home. Would like to see 5 questions to be put on the website as to if you need a building permit on older homes. M/S to table to next month - Roger/Ron. Motion carried. 2 --0 o Review fees - - only changes on additions and alterations. - There should be a renewal fee - permits are for a 1-year period. Board feels that we leave the permits run out on remodeling and if they do, the people would have to apply for a new permit. - M/S by Ron Benson/Roger Ladwig to accept new building inspection fees- Motion carried. 2-0. - Roadmen - Report on work being done. - Filling pot holes - Norbert is on vacation - Library - Report on what is happening at the library - no one present - Recycling/Sanitation Center - Ron Benson - no report - Fire Commission o Update on Town of Green Lake Fire Protection Agreement - - carried over to next month o Suggestions of Ordinances the city would like to implement - Plan Commission - Ron Benson - Omnni came in with proposal on weaknesses in County Land Use - She did a very complete report. We will have another meeting on April 6th at 7:00 p.m. to review. Financial - Treasurer (Kathy not present - report presented by Roger Ladwig. 1. Monthly report. M/S Ron/Roger to approve monthly report - Motion carried. 2. Approval of checks issued from February 9, 2005 - March 8, 2005 checks on 1st National Bank #7728 -7816 totaling $68,676.01 M/S by Ron/Roger - Motion carried 2-0 and Green Lake State Bank #5817-5826 totaling $2,243,432.99. M/S Roger/Ron Motion carried 2-0 Chairman 1. Update on Complaints on W831 North Court junky yard - Roger talked with Zoning - they have had 2 complaints. He checked today and some of the vehicles were gone. County hasn't had time to get out to investigate. 2. Update on North Court driveway for Anderson - He paid for the driveway permit. So that is taken care of 3. Update on DOT meeting on Feb. 28 at Wis. Rapids on Hwy 23 corridor. - Roger attended. From Michael's to north street. Widen the bridge and re-do ($1,000.000.00) - They will have more meetings with the public in May 5, 2005. They are still on a concept - 24 ft paved width. They are talking about shutting off access roads. This is to last until 2030. Starting in 2010. They may have to buy some right a ways. They will be meeting in the area - and will meet with the municipalities before the May 5th meeting. 4. Authorize purchase of mower for Town tractor. $4600. with trade in - we do need a new mower. Ron would like to have a 10-year plan in place by next budget meeting with road equipment. M/S to purchase new mower as presented by Roger from Priebe's with trade-in of old mower for $4600.00 /seconded by Roger - Motion carried 2- 0 i Supervisors 1. Ron Benson - nothing to report j. Clerk 1. Attended workshop at Dale, WI on liquor licensing and State Voter Registration update. - Reported on meetings. 2. Work rules for roadmen (carried over) j. Assessor - no report k. Attorney 1. Update on Fire Dept/First Responder Agreement with City of Green Lake - still working on it 2. Update on Lillian Street home. - county still does not want us involved. 3. Update Hillside/North Court illegal driveway - tried with the broker - house is for sale. If they do not work with us on getting another permit, we should order it to get it removed in May or June. 4. Irving Park Road Damage (update) - Statutes state the one to go after is the one that caused the damage. In this case the carried called the landlord and he stated to come in. So, Bert wants to go after the landlord, as he gave the permission to enter the posted road. - Board supports the idea. 5. Update road damage - Forest, Camelot Trace and Belle Mapps Roads - Roger - we should contact Scott that we are not happy with the offer to settle. Both the amount and the terms - that we have to have them do some work to get anything out of it. Roger feels that Bert should right a letter indicating our concerns about the offer and amount. 1. New Business a. Dartford Cemetery - request for additional funds. b. Informal public comment. - Mr. Reabe - asked if we could put website on agenda. Sydney - wanted to know why Princeton Road wasn't salt/sanded as much - Bert will look into the expiration of building permits - Orlo - suggested that all permits be a 2-year expiration - if not done, then have to take out a new permit. 2. Motion to go into closed session pursuant to WIS STAT Section 19.85 (1)(g) for the purpose of conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. This concerns three (3) pending annexation actions involving Nordic Village and Busse lands both east and west of CTH A. Case Numbers 04CV99, 04cV98 and 04CV97. Motion/Second by Roger/Ron to go into closed session: Roll Call - Roger - Yes Ron Yes. Motion carried 2-0. 3. Motion to reconvene into open session. 4. Action upon matters discussed in closed session. No action taken 5. Adjournment. - Next Town Board Meeting - April 12, 2005. 7:00 p.m. M/S to adjourn - Ron/Roger ---- 9:00 P.M.
