Minutes 

- Call Meeting to order by Mike Wuest at 7:00 p.m. Present: Mike
Wuest, Chairman, Ron Benson & Susan 
McConnell, Supervisors; Kathleen Morris,Treasurer; Marian
Mildebrandt, Clerk; Robert Wertsch, Attorney; Jerry Buhrows, Building
Inspector 
- Pledge of Allegiance - Said by all in attendance. 
- Informal public comment time on issues not on the agenda for
tonight's meeting: JoAnne LaMire - wanted to 
know why we are going into closed session. Mike Wuest- not at this
time. Syndey Rouse - wanted to know who was on the Plan Commission.
Ron Benson - indicated he is chairperson, Clerk told her the committee
members. 
She thinks it is strange that with the make-up of the Commission
contains no real estate agents, since they are a major portion of the
businesses in the area. Ron indicated that the Plan Commission
meetings are open meetings 
and no one comes to express any opinion. 
- Are we in compliance with open meeting law, and rules of meeting..
Yes, the agenda was published in the Green Lake Reporter and posted at
the Town Office, Classic Auto Service and the Recycling/ Sanitation
Center. 
- Approve Minutes of April 12, 2005 meeting. M/S to approve the
minutes of the April 12th meeting as presented . 
Susan McConnell - found many errors in typing, she will give to Clerk
to correct. - M/S Ron Benson/Susan McConnell, Motion Carried. 
- Reports 
o Building Inspector. Report on any building permits issued. - Issued
6 in April. 

Update on Review of UDC Ordinance and fees to renew building permits.
- some of the 
additions/alterations are coming due. If things go on indefinitely,
he has to inspect and it would be over the original fee and could
start costing the town money. Ron Benson- thinks the idea to have them
re-apply whether or not be charge for the permit, so we know that it
is being done. Ron Benson- thinks we should ask for a renewal 
- Draft a letter as a review and access at that time. 

UDC Ordinance - if it should be adopted for all houses. Motion by Ron
Benson we leave UDC Code as it and not to inspect homes prior to 1980.
Susan McConnell does not feel that it should be left as is.She thinks
that if $1000 is used in remodeling, they should have a building
permit. Ron's motion seconded by Mike Wuest. 
Motion 2 Yes 1 No. Motion carried. 

Currently if you re-do your roof or siding and cost is over $1000 you
need a permit for homes built since 1980. - Mike Wuest - leave as is.


o Roadmen - Report on work being done. Mike Wuest - Norbert Jahnke
has been doing patching and we 
have been sweeping up gravel. We are involved in the Community
Service Program. Eugene Janes is 
supervising these individuals. Ron Benson pointed out that there are
tires at the bottom of Skunk Hollow. 
o Library - Report on library activities - There are children
programs on during the summer. Story tellers come in on Wed. mornings.
Over 100 kids at times in the past. They show movies 2x's a month for
children. They tried to show an adult movie, low interest. We cannot
advertise outside for the movies as part of the contract. Artist of
the month is still on going and well received. 

 
Mike Wuest - the town received an e-mail from Tasha requesting to
meet with the town regarding long-range planning for the Library. She
has offered to the meeting down at the library. - We are requested to
give her some dates we can get together. Possibly June 2 - The Library
board meets on that day. - so that day may not work. 

o Recycling/Sanitation Center - Ron Benson 

The fence has been repaired 
The large dumpster is in place for larger items 

 (Question) Sydney Rouse- there is a large pot hole in the center
that she is concerned about. - Mike Wuest will check it out with
Norbert Jahnke 

o Fire Commission 
! Approve Town of Green Lake Fire Protection Agreement - We have the
Town of Green Lake Fire 
Protection Agreement - dated Feb. 2, 2005. Attorney - no problem with
the agreement, but the 
map wasn't very clear to the area. M/S Susan McConnell/ Ron Benson to
accept the agreement 
with the Town of Green Lake from Feb. 1, 2005 for 1 year. We will get
$4,000 which we have to 
split with the City. 
! Update on suggestions of Ordinances the city would like to
implement - no one has said anything 
about this, so we will drop until the Fire Commission brings more
information to the Town Board. 

o Plan Commission - Ron Benson 
! Discuss Subdivision/Land Use Ordinance - June 2, 2005 at 7:00 for
public hearing - for Land Use /Subdivision here at the Town Office -
Motion as such: M/S Susan McConnell/Ron Benson. 
Will need Class 2 notice in on May 19 and May 26. 

It will be available for inspection here at the Town hall and also at
the Caestecker Library. It is available on the Omnni website. 

! Recommendations regarding a request by Jeff Rowley for Conditional
Use and Rezoning. The Rezoning request is from A-1 Exclusive
Agriculture District to RC Recreational District. The Conditional Use
permit is for a public educational and recreational resort. The area
affected is 27+ acres at W1958 Northwest Road. 
- The Plan Commission recommended changing the zoning, but had 7
issues that needed to be 
addressed before they would approve the conditional use. 

1. Complete site plan 
2. Signage 
3. Site lighting 
4. Maintain quiet setting 
5. Subject to review 
6. Future gym - separate item. 
7. Papers about the dump site - DNR papers 

COMMENTS: Mrs. Westphal - is he required to clean up his lot before
he starts another project. She knows it is a registered dumpsite. She
feels that it should be cleared up before we rezone. JoAnn LaMire -
does he run a business out of his home. If he does, it's illegal to
run a business out of a residence. She feels that it does not meet the
land use plan that we adopted. Mr. Westphal - he is concerned with the
traffic on Northwest road - He has an access to County Road A then the
traffic problem would be on a County Road. Sydney - Does he have a
Business Plan - has he done a study on it. Susan M - it sounded like
he has traveled different areas and it sounds like it would go.
Concern is if it will be successful. 

 Roll call on Rezoning: with note Susan McConnell, seconded Ron
Benson - from Ag 1 to RC 1 

Roll Call - Mike Wuest Yes, Susan McConnell Yes, Ron Benson Yes,
Motion 3 - 0 . Recommendations to also address junkyard and County A
access. 

o Financial - Treasurer 
! Monthly report. - Ron Benson/Susan McConnell - Motion carried. 
! Approval of checks issued from April 13, 2005 - May 9, 2005. Checks
7875 - 7987 for a total of 
$123,447.95 M/S Ron/Susan Motion 3-0 


o Chairman 
! Discuss Road Inspections - Mike Wuest made up a packet of items we
want to do this year. 
Roads that were discussed on the road trip. Photos were taken 

1. Irving Park Drainage, - drainage 
2. Dead Cotton wood tree on Northwest Road - should be taken down.
Board directed 
Chairman to get quotes from the public 
3. Spaulding Hill Road - Hill drainage, landowner agreed to pay for a
new culvert if we fix the 
road. Susan McConnell would like an estimate on what it will cost at
the next meeting. 
! Appoint Orlo Bierman to Fire Commission - 3 year term - June 1,
2005 thru May 31, 2008. 

He accepted the appointment. M/S Ron Benson /Susan McConnell - to
Appoint Orlo Bierman to 
the Fire Commission. Motion carried. We will do a thank you note to
Wayne Albright for his 
service on the commission 

! Resolution 2005-01 - Carried over 

 Attorney 

! Update on Fire Dept/First Responder Agreement with City of Green
Lake - No action at this 
time. 
! Irving Park Road Damage (update) - There have been discussions with
parties involved in the 
damage to the road. The trucking company has agreed $600.00 for
damage to road. Property 
owner who told him to come in will pay $200 toward total bill. The
problem arises that there may 
have been other trucks with heavier loads that could have done the
damage. M/S Ron Benson/Susan McConnell to accept the settlement NOTE:
The burden of proof would have been hard to prove which truck did the
actual damage. Motion carried 3-0 
! Update road damage - Forest, Camelot Trace and Belle Mapps Roads -
- Scott's offer was to pay 
$450. by credit against future work. The Board would like cash
instead of credit. He thinks will be in the mail next week. M/S Ron
Benson/Susan McConnell to accept the damages Motion carried 
3-0 

- New Business 

o Cell phone - pay 1/2 of cell phone bill for clerk - Motion / Ron
Benson / to allow 1/2 monthly bill/ Susan McConnell disagrees She
agreed to check out different plans and report back next month. 
o Purchase laptop computer - - Susan McConnell will get quotes for
next month. 

- Public Comment - on Annexation issue. - JoAnn LaMire - doesn't
think there is any reason for the lawsuits against the City. It's just
throwing money away and a bad decision to make. Mike Wuest - he was at
the city Council meeting last night and he extended the olive branch.
- JoAnn LaMire - The residents of the city think we are being very
uncooperative. - In her opinion let's bury the hatched and get going
with the business. Let's move on and stop spending money
unnecessarily. Mike Wuest. Addressing your issue with the City - He
has had conversation with the Mayor. JoAnn LaMire - she would like to
see the lawsuits be dropped. - 

Sydney Rouse- thinks we should also drop the lawsuits. ---- On other
subject - - Back to building inspections. - If someone starts residing
the house - you should not be allowed to stop halfway through. Are you
operating under village powers. - - Can we go to a 5 man board - Bert
Wertsch - yes, we can one way is at the annual meeting another is
through board action. -- On Irving Park - GL Sanitary district had
money for this kind of repairs. -- On re-shingling house - she thought
if you put the roof on the house once, it should not need a permit to
replace. - Does this board have any pull with the County A - - Mike
Wuest will check with County Highway Dept.. 

 
Harley Reabe - on the renew. of building permits. He thinks it should
not be allowed to just keep renewing. 

Orlo Bierman - Northwest road - Lillian Street/ N. Lawson - seems to
carry on for a year or more. Does the town of Brooklyn have ordinance
on junk yard. --- Is there an ordinance on these kind of problems. 

Sydney - If a business - a port-a-potty - is there a limit on how
long you can have themÉ It's been 3 years. --- 
We do not have an ordinance 

 
Regarding Annexation --- Mike Wuest this is only his 2nd meeting as
Chairman. He has been meeting with the Mayor. It will be discussed in
the closed session. We hope to end this in a timely manner. 

- Implement Employee Handbook - M/S Susan McConnell, Ron Benson to
accept the employee handbook - Motion carried. 3-0 
- Motion to go into closed session pursuant to WIS STAT Section 19.85
(1)(g) for the purpose of conferring with legal counsel for the
governmental body who is rendering oral or written advice concerning
strategy to be adopted by the body with respect to litigation in which
it is or is likely to become involved. This concerns three (3) pending
annexation actions involving Nordic Village and Busse lands both east
and west of CTH A. Case Numbers 04CV99, 04cV98 and 04CV97. M/S as
listed above. Susan McConnell/Ron Benson Roll call Mike Wuest, Yes;
Susan McConnell,Yes; Ron Benson Yes - Motion carried 3 -0 
- Adjournment. - Next Town Board Meeting - June 14, 2005. 7:00 p.m.
